TERMS & CONDITIONS

Subject of the contract

By these general conditions of sale, Olfactory Code sells and CUSTOMER purchases at a distance the tangible movable goods indicated and offered for sale on the site.

The contract is concluded exclusively through the Internet, by means of the CUSTOMER accessing www.codiceolfattivo.com and placing a purchase order in accordance with the procedure provided by the site itself.

The CUSTOMER undertakes to read, before proceeding to confirm his/her order, these general conditions of sale, in particular the pre-contractual information provided by Olfactory Code and to accept them by order confirmation.

In the order confirmation email, the CUSTOMER will also receive indications to consult these general conditions of sale, as provided for in Article 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

The CUSTOMER, before the conclusion of the purchase contract, takes note of the characteristics of the goods, which are explained in the individual product sheets at the time of selection.

Prior to the conclusion of the purchase contract and before the validation of the order, the CUSTOMER is informed regarding:

• the total price of the goods including statutory taxes, with details of shipping costs and any other additional costs (which can be checked in the "Checkout" section of the site);
• payment methods;
• the deadline by which Olfactory Code agrees to deliver the goods (which can be checked in the "Shipping" section of the site);
• the conditions, terms, and procedures for exercising the right of withdrawal (which can be checked below in these conditions) as well as type of withdrawal form in Annex I, Part B of Legislative Decree 21/2014;
• information on how to return the contracted goods, with notice that the CUSTOMER will have to bear the costs of returning the goods in case of withdrawal (which can be verified in the "Shipping" section of the site);
• The existence of the legal warranty of conformity for the purchased goods;
• after-sales service conditions (which can be checked in the "Contact" section of the site;

The CUSTOMER may at any time, and in any case before the conclusion of the contract, take cognizance of the information about Olfactory Code, the geographical address, telephone number, e-mail address, information which is given, also below:

Conclusion and effectiveness of the contract

The sales contract is considered concluded with the sending by Olfactory Code to the CUSTOMER of an email confirming the order.

The order confirmation email contains the CUSTOMER's data, the order number and date, the price of the purchased goods, the shipping costs and the delivery address to which the goods will be sent, and the indication to consult these general conditions of sale.

The CUSTOMER agrees to verify the correctness of the personal fiscal and business data provided with the completion of the order, which are replicated in the order confirmation email. The CUSTOMER agrees to promptly notify Olfactory Code of any errors, changes, corrections.

Olfactory Code strives to describe and present the items sold on the site in the best way possible. Nevertheless, some errors, inaccuracies or minor differences between the site and the actual product may show up. Photographs and drawings of products presented on the site www.codiceolfattivo.com do not constitute a contractual element as they are only representative.

Olfactory Code undertakes to deliver the goods within 30 days starting from the sending of the order confirmation email to the CUSTOMER.

The products ordered and purchased by the Customer are intended exclusively for the Country/Nation indicated on the order Olfactory Code disclaims any responsibility in the event that the CUSTOMER decides to enter the products ordered and purchased in a different Country/Nation.

Product availability

The immediate availability of products should be considered purely indicative because, as a result of the simultaneous presence on the site of several users, products may be sold to other CUSTOMERS before the confirmation of the order.

Even after sending the order confirmation email sent by Olfactory Code there may be cases of partial or total unavailability of goods. In this eventuality, the CUSTOMER will be promptly informed and may proceed with the elimination of the unavailable product.

Methods of payment

Possible modes of payment are:

• credit card

It is understood that the processing of orders for which the CUSTOMER has chosen payment by bank transfer in advance, will be subject to receipt of the bank account bearing CRO number.

Prices

All product sales prices shown on the website www.codiceolfattivo.com are expressed in Euros and include VAT.

Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made. The conditions can be seen in the "Shipping" section of the site.

The CUSTOMER accepts the right of Olfactory Code to change its prices at any time, however, the goods will be invoiced based on the prices listed on the site at the time the order is created and indicated in the confirmation email sent by Olfactory Code to the CUSTOMER.

In the event of computer, manual, technical, or any other error that may result in a substantial change, not foreseen by Olfactory Code, in the sale price indicated on the site, making it exorbitant or clearly derisory, the purchase order will be considered invalid and cancelled and any amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.

Article

In accordance with applicable legal provisions, the CUSTOMER has the right to withdraw from the purchase without penalty and without specifying the reason, within the period of 14 days from the date of receipt of the products.

The CUSTOMER who intends to exercise the right of withdrawal must give prior notice to Olfactive Code by means of an explicit declaration, which may be sent by registered letter with return receipt or by e-mail.

The CUSTOMER may also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, set out in Annex I, Part B , Legislative Decree 21/2014 (not mandatory), the text of which is reproduced below:

If the right of withdrawal is exercised, the CUSTOMER is required to return the goods within 14 days from the day on which he/she communicated to Codice Olfattivo his/her wish to withdraw from the contract pursuant to Article 57 of Legislative Decree 206/2005.

Products must be returned unused, undamaged, undamaged, in their original packaging, complete in all their parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation. Products must be accompanied by written justification on customer's letterhead, stamped and signed by the same.
Olfactory Code reserves the right to credit and refund at a lower value than the value of purchase by the CUSTOMER what was returned, if the above conditions are not met.

Without prejudice to the right to verify compliance with the above, Codice Olfattivo will refund the amount of the products subject to withdrawal within a maximum period of 14 days.

which undertakes to verify and evaluate the condition of the returned goods, crediting the CUSTOMER with the issuance of regular accounting document (i.e. Credit Note).

Direct costs of returning products are the full responsibility of the CUSTOMER, unless expressly waived by Olfactory Code . and on the further condition that CUSTOMER uses Courier indicated by Olfactory Code. .

As provided for in Article 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, Olfactory Code  Can suspend the refund until the goods are received.

Olfactory Code will make the refund by bank transfer and if the CUSTOMER wishes to exercise his/her right of withdrawal, he/she must provide Olfactory Code with, the complete bank details: IBAN, SWIFT and BIC, and all other data deemed necessary to make the refund.

Legal guarantee of conformity

If the CUSTOMER receives products that do not meet their intended use or are defective, the CUSTOMER has the right to restore the product's conformity without charge by repairing or replacing the product. The CUSTOMER may exercise this right if the defect becomes apparent within thirty days of delivery of the goods and reports the defect to Olfactory Code Within five of discovery.

Method of delivery and fiscal documents

The products ordered will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order no later than 30 days from the date of receipt by the CUSTOMER of the order confirmation email sent by Codice Olfattivo

For each order processed, appropriate tax documentation (DDT or accompanying invoice) is issued to accompany the goods shipped. The tax documentation issued shows the information provided by the CUSTOMER during the purchase procedure. After the invoice is issued, it will not be possible to make any changes to the data indicated in the invoice.

Responsibility

Olfactory Code assumes no liability for inefficiencies attributable to force majeure or fortuitous events, even where dependent on malfunctions and inefficiencies of the Internet network, in the event that it fails to execute the order within the time stipulated in the contract.

The CUSTOMER has the right to access the site for browsing and making purchases. No other use, particularly commercial, of the site or its content is permitted.

All trademarks are those of their respective owners and are mentioned only to simplify the search for compatible products.

Integrity

These General Terms and Conditions of Sale consist of the entirety of their component clauses.

If one or more of the provisions of these Terms and Conditions is deemed invalid or declared invalid under law, regulation, or following a decision by a court having jurisdiction, the other provisions shall continue in full force and effect.

Applicable Law and Jurisdiction

These General Conditions of Sale are governed by Italian law.

Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of Novara.

In any case, optional recourse may be had to the mediation procedures set forth in Legislative Decree 28/2010, as amended, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale
